School Law for the Art Teacher

While searching for appropriate law cases in reference to Christian Art, I
found an additional case that will interest art teachers. This will be of
interest to art teachers who can't get properly vented kilns in the
classroom.

(Cirelli v. Johnston Sch. Dist., 897 F. Supp. 663, DRI 1995) "The
defendents were enjoined from prohibiting a high school art teacher from
releasing videotapes regarding health and safety conditions at the school
recorded on school days during nonschool, non-working hours when the
plaintiff was properly on school grounds.
Although her awareness of health and safety issues was triggered by her
own health problems and a suggestion by her doctor that her symptoms could
be related to environmental conditions at her workplace, she was commenting
on a matter of public concern. The plaintiff's right to comment on health
conditions outweighed any hardship the defendants might suffer through
strained personal and professional relationships and a concern for a
negative public image of the school.
However, the court held that the plaintiff did not have an unconditional
right to enter the high school and videotape at all times. The defendants
could properly require that she apply for permission to enter the building
on weekends or at other times when access would normally be limited."

Summation: An art teacher has a legal right to complain about health
conditions unique to their work environment. The issue is a matter of
public concern.
