Here is another one that I need to revise.... I have been putting
copyright statements on all lessons using photographs. For this
lesson, students are making a "derivative work" - a violation of
copyright law. I will correct this lesson today.
Fair Use is your defense - but even that is not a given as fair use
technically does not give you permission to make a derivative work
from a copyrighted photograph.
You will not get permission from the copyright holders - as many sites
do not even give you that information. Once you DO write for
permission, your request will go unanswered. Do save your
correspondence - and do the lesson anyways as you made the effort.
Also contemporary celebrities and their estates (for those deceased)
hold the rights to their image. I will write to the Dr. Martin Luther
King, Jr. Foundation for permission to keep this lesson on Incredible
Art Department.
Since so many people visit Education World(R) - I will also send this
to them asking them to update their lesson. Art Teachers can not
continue to tell students it is OK to violate copyright laws. We need
to teach them some real world lessons as well. No copyright holder (or
estate) would file a "cease and desist" for this lesson - but I will
indicate on the lesson some real cases that have taken place.
